Terms of Service

Berrytap is a platform where creators build paid communities — with courses, a social feed, events, and members on the same journey — and where members join those communities. In these Terms, “Berrytap,” “we,” “us,” and “our” refer to the operator of the Service; “you” refers to the person using it.

You must be at least 13 years old to use Berrytap, and at least 18 (or the age of majority where you live) to make purchases, sell access to a community, or receive payouts. If you use Berrytap on behalf of an organization, you represent that you are authorized to accept these Terms for it.

• You are responsible for the accuracy of your account information and for keeping your login credentials secure.
• You are responsible for all activity that happens under your account. Tell us promptly at support@berrytap.com if you suspect unauthorized use.
• You may sign in with email and password or with a third-party provider such as Google. If you use Google Sign-In, your use is also subject to Google’s terms.

Creators set the price, rules, and content of their communities. Members join subject to those rules. You retain ownership of the content you post. By posting content on Berrytap, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content solely to operate and provide the Service (for example, showing your posts to other members of your community).

You are solely responsible for your content and must have the rights to post it. Creators are responsible for the communities they run, including the accuracy of what they advertise and their conduct toward members.

You agree not to use Berrytap to:

• break any law or infringe anyone’s intellectual property or privacy;
• post content that is unlawful, hateful, harassing, deceptive, or sexually exploitative of minors;
• distribute malware, spam, or attempt to gain unauthorized access to the Service or other accounts;
• defraud members or creators, launder money, or process payments for goods or services not permitted by these Terms;
• scrape, resell, or reverse-engineer the Service except as permitted by law.

We may remove content or suspend accounts that violate these Terms.

Community memberships are sold in Mongolian tögrög (₮, MNT). Depending on the community, you may pay through:

• QPay — a one-time payment you complete by scanning a QR code with your bank app. For recurring memberships, a new invoice is issued each billing period, which you pay manually before it is due.
• Card (Visa/Mastercard) — you may save a card and enable automatic renewal, in which case we charge your card at the start of each period. Cards are charged in MNT; your bank handles any currency conversion.

If a payment is not completed by its due date, a grace period applies, after which access to the community may be suspended until payment is made. You authorize us and our payment providers to charge your selected payment method for the amounts shown at checkout, including recurring amounts if you enable auto-renewal. You can turn off auto-renewal at any time in your settings; this stops future automatic charges but does not refund the current period.

Except where required by law, payments are non-refundable. Individual creators may offer their own refund policies for their communities; those are between you and the creator. If you believe you were charged in error, contact support@berrytap.com.

When you sell access to a community, Berrytap collects payments on your behalf and retains a platform fee of 2–10%, depending on the community's plan, of each successful membership payment. The remaining balance accrues to you and is shown in your creator dashboard.

• You may request a payout of your available balance to the bank account you provide. We review and transfer payouts manually; timing may vary.
• You are responsible for providing accurate payout details and for any taxes owed on your earnings. We may withhold or adjust payouts to correct errors, chargebacks, refunds, or suspected fraud.
• Payment processing fees charged by our providers may apply in addition to the platform fee.

The Berrytap name, logo, and the Service’s design and software are owned by us and protected by law. These Terms do not grant you any right to use our branding without permission. All rights not expressly granted are reserved.

You may stop using Berrytap and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service, members, or creators. On termination, your right to use the Service ends; sections that by their nature should survive (such as payment obligations, disclaimers, and limitation of liability) will remain in effect.

Berrytap is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or secure, and we are not responsible for the content, conduct, or communities of creators or members.

To the fullest extent permitted by law, Berrytap will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid to Berrytap in the three months before the claim, or ₮50,000.

These Terms are governed by the laws of Mongolia, without regard to its conflict-of-laws rules. Any disputes will be handled by the competent courts of Mongolia, unless a mandatory law where you live provides otherwise.

We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you. Your continued use of Berrytap after changes take effect means you accept the updated Terms.
